Terms of Service

These terms apply to all requests and bookings arranged by Xalibur Travel, including private aviation charter brokerage. By sending a request or confirming a booking, you accept them.

01

Who we are

Xalibur Travel is a trading name of Xalibur Travel OÜ, registry code 17622510, Vesivärava tn 50-201, 10152 Tallinn, Estonia, VAT EE103041636. We are an independent travel advisor affiliated with the host agency Little Emperors (IATA 96020293). Contact: welcome@xaliburtravel.com, +371 28 552 855.

02

Our role

Xalibur Travel acts as an intermediary and agent on your behalf. We do not own or operate hotels, aircraft, yachts or vehicles. Each service is provided by its supplier under a contract between you and that supplier, and the supplier's own terms and conditions apply in addition to these terms. We will share the key supplier conditions with you before you confirm.

03

Requests, proposals and confirmation

  • Proposals and prices are indicative until confirmed by the supplier; availability and prices may change until the booking is confirmed.
  • A booking is confirmed when the supplier has confirmed it in writing and any required deposit or payment has been received.
  • Please check all names, dates and details in each confirmation and tell us immediately about any error.
04

Prices, payment and our remuneration

  • Payments are made according to the supplier's deadlines — either directly to the supplier or through us, as stated in the confirmation.
  • Our work is usually remunerated by commission paid by suppliers, at no extra cost to you. Where a service fee applies, it is agreed with you in writing in advance.
  • Prices are quoted in the supplier's currency unless stated otherwise. Bank charges and currency conversion costs are borne by the payer.
05

Changes and cancellations

Changes and cancellations are subject to the supplier's terms, which may include fees or non-refundable payments. We will help you with any change, but cannot guarantee that a supplier will accept it. Any service fee agreed with us is non-refundable once the work has been performed, unless agreed otherwise.

06

Private aviation

  • Xalibur Travel acts as a charter broker as agent on behalf of its clients. We are not an air carrier and do not operate aircraft.
  • All flights are operated by licensed air carriers holding a valid Air Operator Certificate (AOC). The operator's name is disclosed to you before confirmation, and the operator retains full operational control of the flight.
  • The charter contract is concluded between you and the operator, or by us on your behalf and with your authorisation, under the operator's terms.
  • Departure times, routings and aircraft may change for safety, weather, air traffic control or technical reasons. Such decisions rest with the operator and the captain.
  • Empty-leg flights depend on the primary charter and may be changed or cancelled by the operator at short notice.
  • Passengers must observe the operator's rules on documents, luggage, dangerous goods and conduct on board.
07

Yacht charters

Yacht charters are arranged with owners and licensed charter agents under their charter agreements, which set out the deposit, payment schedule, Advance Provisioning Allowance (APA), cancellation terms and rules on board.

08

Lifestyle and family office services

For concierge, events, art, interiors and family office requests, we coordinate and organise services provided by independent specialists. We do not provide medical, legal, tax or investment advice. Medical services are provided solely by licensed clinics and practitioners; art acquisitions are supported by independent experts, and we make no representation about the investment value of any work.

09

Package travel

Unless we expressly state in writing that a booking is a package travel contract, each travel service is booked as a separate contract with its supplier, and the rights applicable to package travel do not apply. Where a package is offered, you will receive the required pre-contractual information before booking.

10

Travel documents, health and insurance

You are responsible for valid passports, visas, health requirements and any permits needed for your trip, and for providing correct traveller details. We strongly recommend comprehensive travel insurance, including cancellation and medical cover, from the moment of booking.

11

Partner privileges

Benefits at partner hotels, such as breakfast, hotel credit or upgrades, depend on the brand, hotel, rate and booking conditions, are subject to availability and are confirmed with each booking. They have no cash value.

12

Liability

We perform our services with due care and skill and are responsible for our own acts and omissions. We are not liable for the acts, omissions or insolvency of suppliers, or for events beyond our reasonable control, including weather, strikes, pandemics, government measures or force majeure. Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence, or your mandatory rights as a consumer.

13

Complaints and governing law

If something is not right during your trip, please tell us and the supplier immediately so we can help on the spot. Written complaints can be sent to welcome@xaliburtravel.com; we will respond within 14 days. These terms are governed by Estonian law. Consumers may also turn to the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (www.ttja.ee). Disputes are settled by Harju County Court, without prejudice to the mandatory rights of consumers in their country of residence.

14

Changes to these terms

We may update these terms. The version published on this page at the time of your booking applies to that booking.
